Walker Blue partnered with a Michigan school district to certify and maximize the Investment Tax Credit (ITC) for a solar energy project at a middle school. This initiative demonstrates how public institutions can leverage federal incentives under the Inflation Reduction Act to reduce energy costs, promote environmental stewardship, and enhance educational opportunities in STEM fields. The middle school’s ITC-eligible costs totaled $3.5 million, yielding a tax credit of $1.4 million, which translates into a cash refund from the IRS through Direct Pay under the IRA.

The middle school serves grades 6-8 and acts as a community hub with classrooms, labs, a gymnasium, and athletic fields. Facing high energy demands from year-round operations, the district installed a 540 kW AC roof-mounted photovoltaic (PV) system alongside necessary roofing upgrades. The project, completed in conjunction with a roof replacement, integrates seamlessly with the existing infrastructure to offset a significant portion of the school’s annual electricity use.

## Overview

- **Construction Start**: December 29, 2023
- **Placed in Service**: June 12, 2025
- **Total Project Cost**: $5,108,961
- **ITC-Eligible Cost Basis**: $3,501,317

## ITC Certification and Adders

Walker Blue conducted a thorough analysis to substantiate ITC eligibility under IRC Section 48. Key findings include:

- **Base ITC Rate**: 30% for qualifying energy property.
- **Domestic Content Adder**: 10% bonus, verified through a detailed cost-trace methodology showing over 40% domestic content in manufactured products (exceeding the 2024 threshold).
- **Total ITC Rate**: 40%, yielding a tax credit of $1,400,527.
- **Other Adders**: The project did not qualify for the Energy Community or Low-Income Communities adders, as the site is not in a designated area.

The system’s capacity, under 1 MW AC, automatically qualified for Prevailing Wage and Apprenticeship (PWA) compliance, simplifying the process and ensuring access to the full base credit.

Our methodology involved reviewing invoices, contracts, and supplier data to allocate costs accurately. Partial eligibility was applied to roofing and consultant fees, ensuring only solar-supporting elements were claimed.

| **Work Activity** | **ITC Eligibility** | **Total Cost** | **ITC Eligible Cost** |
| --- | --- | --- | --- |
| Solar Design & Material | Full | $1,955,289 | $1,955,289 |
| Solar Installation | Full | $585,880 | $585,880 |
| Roofing Replacement | Partial | $2,286,213 | $816,194 |
| Roofing Design Consultant | Partial | $93,686 | $33,447 |
| Roofing Administration Consultant | Partial | $55,620 | $19,857 |
| Owner’s Consultant Fee | Partial | $132,273 | $90,650 |
| **Total** | | **$5,108,961** | **$3,501,317** |

## Benefits & Impact

This project not only reduces operational costs but also serves as a teaching tool for sustainability. By offsetting energy use, the school district demonstrates leadership in green initiatives, inspiring students and the community. Walker Blue’s certification ensured compliance and maximized incentives, providing a model for other educational institutions pursuing renewable energy.

The Opportunity

## What the Investment Tax Credit covers, and why it matters.

The federal Investment Tax Credit (ITC) is one of the largest commercial energy incentives in the U.S. tax code. It supports investment in clean electricity property and can be combined with bonus credits, transferred to third parties, or claimed as cash by tax-exempt entities through Direct Pay.

### §48 (legacy ITC)

The legacy Investment Tax Credit under Internal Revenue Code §48 covers projects that began construction before applicable transition dates. Eligibility, credit percentage, and bonus structure depend on technology type, construction-start timing, and compliance with prevailing wage and apprenticeship rules.

### §48E (clean electricity ITC)

The technology-neutral Clean Electricity Investment Credit under §48E applies to projects placed in service after the §48 transition. It applies to facilities that produce electricity with zero greenhouse gas emissions and is subject to the same PWA, Domestic Content, FEOC, and documentation requirements as §48, with its own phase-out and eligibility rules.

### Direct Pay (Elective Pay)

Tax-exempt and government entities, including school districts, municipalities, public housing authorities, hospitals, universities, and nonprofits, can receive the cash value of eligible ITC credits even with no federal tax liability. Pre-filing registration and documentation are required.

### Transferability (§6418)

Eligible taxpayers can transfer all or a portion of certain ITC credits to unrelated third-party buyers for cash. Transferability has reshaped how renewable energy projects are financed, but it requires careful documentation, partnership-flip considerations, and buyer due diligence support.

Eligible Technologies

## The ITC applies across a wide range of clean energy property.

Eligibility, credit value, and bonus structure vary by technology and configuration. Walker Blue evaluates each project on its specific facts.

Maximizing Value

## The base credit is just the starting point.

The full ITC value depends on bonus credit eligibility. Structuring decisions made early in the project, wage practices, sourcing, project location, customer profile, can meaningfully change the credit percentage. The bonuses below stack, subject to eligibility and documentation.

Prevailing Wage & Apprenticeship

### PWA Bonus

Projects meeting prevailing wage and apprenticeship requirements may qualify for a substantially higher credit rate. Documentation must cover the construction period and applicable alteration or repair periods. Recordkeeping is the single most common audit risk.

Domestic Sourcing

### Domestic Content Bonus

Projects meeting domestic content thresholds for steel, iron, and manufactured products may qualify for an additional bonus credit. Sourcing certifications and supplier documentation are mission-critical, and the thresholds change over time.

Project Location

### Energy Community Bonus

Projects sited in qualifying energy communities, including certain census tracts with historical fossil fuel activity, brownfield sites, or coal closure communities, may qualify for an additional bonus credit. Eligibility maps update over time.

Targeted Allocation

### Low-Income Communities Bonus

The §48E Low-Income Communities Bonus Credit Program allocates additional credit value to qualifying solar and wind facilities serving low-income households or communities. Allocation is application-based and capacity-limited.

Direct Pay / Elective Pay

## Tax-exempt? You may be able to claim the ITC as cash.

Under the Direct Pay election, eligible tax-exempt and government entities can receive the cash value of qualifying federal energy credits, even with no federal tax liability. Walker Blue manages the engineering documentation and supports pre-filing registration through claim.

- School districts, public colleges and universities, and K-12 systems
- Municipal governments, counties, states, and Indian tribal governments
- Public housing authorities (PHAs) and other tax-exempt instrumentalities
- Rural electric cooperatives and certain nonprofit organizations
- Hospital systems, religious organizations, and other 501(c) entities

What to Watch

## Where ITC value most often gets eroded.

Most credit value lost on an ITC project isn't lost at the IRS, it's lost in structuring, sourcing, or documentation decisions made earlier. Three areas are responsible for the majority of credit erosion.

### PWA recordkeeping

Inconsistent or incomplete prevailing wage and apprenticeship records can disqualify the bonus credit. Documentation must cover the full applicable period and reach all contractor and subcontractor tiers.

### FEOC / Prohibited Foreign Entity exposure

FEOC and Prohibited Foreign Entity restrictions can put credit value at risk if supply chain, ownership, or licensing relationships aren't reviewed before key transactions. Diligence and documentation matter early.

### Construction-start & placed-in-service timing

Begin-construction documentation, continuity requirements, and placed-in-service dates determine which credit regime applies, and how the bonus credit rules read on the project. Timing is structural, not cosmetic.

Timing Matters

## ITC value depends on project facts, and on getting in front of them early.

The earlier in the project Walker Blue is involved, the more of the credit value is structurally protected. Eligibility reads are fast; reworking a project after construction-start to recover lost bonus credit value is not.

Common Questions

## Frequently asked.

What's the difference between §48 and §48E?

§48 is the legacy ITC that applies to projects with qualifying construction-start dates before applicable transition rules. §48E is the technology-neutral Clean Electricity Investment Credit that applies to qualifying zero-emissions facilities placed in service after the transition. Both share PWA, Domestic Content, FEOC, and documentation frameworks, with their own eligibility and phase-out rules. Which regime applies depends on the specific project facts.

Can tax-exempt or government entities really claim the ITC?

Yes, through Direct Pay (Elective Pay). Eligible tax-exempt and government entities can receive the cash value of qualifying federal energy credits even with no federal tax liability. Pre-filing registration is required, and documentation must hold up under IRS review. Walker Blue manages the engineering and registration support end-to-end.

How does the ITC for geothermal differ from solar?

Geothermal eligibility, bonus credit pathways, Domestic Content sourcing rules, and energy modeling requirements differ meaningfully from solar. Many tax firms are solar-trained and treat geothermal as a variant, Walker Blue's engineers work both technologies and apply the rules that actually fit geothermal projects.

What does PWA compliance actually require?

Prevailing Wage and Apprenticeship rules generally require paying prevailing wages to laborers and mechanics, using qualifying apprenticeship hours on the project, and maintaining detailed records across contractor and subcontractor tiers. Documentation needs to cover the applicable construction period and may extend to alteration or repair periods. Recordkeeping discipline is the most common point of failure.

What is FEOC / Prohibited Foreign Entity exposure?

FEOC (Foreign Entity of Concern) and Prohibited Foreign Entity rules can affect ITC eligibility based on supply chain, ownership, and licensing relationships. The rules are evolving and project-specific. Walker Blue helps evaluate exposure before key transactions and structures documentation to support compliance.

Can ITC credits be sold to another taxpayer?

Yes, eligible taxpayers can transfer all or a portion of certain ITC credits to unrelated third-party buyers for cash under §6418. The transferability market has reshaped renewable project finance. Walker Blue supports the documentation, diligence, and engineering substantiation that buyers and underwriters expect.

How does Walker Blue work with our CPA, ESCO, or A&E firm?

White-label and co-branded engagements are standard. We support our partners' client relationships rather than compete for them. Many engagements are routed through CPA firms, ESCOs, MEP firms, or A&E partners, the project owner stays with the relationship they trust.
